Employment-Based Immigration: first Preference EB-1
You might be eligible for an employment-based, first-preference visa if you are an alien of extraordinary ability, are an outstanding professor or scientist, or are a certain international executive or manager. Each occupational category has certain requirements that need to be satisfied:
Your petitioning company needs to be a U.S. employer and plan to employ you in a managerial or executive capability. The petitioner should have been doing business in the U.S. for a minimum of 1 year, as a legal entity with a certifying relationship to the entity that used you abroad in a supervisory or executive capability.
No labor accreditation is needed.
* Criteria for Demonstrating Extraordinary Ability
In order to show you have actually sustained national or global recognition which your accomplishments have been recognized in your field of expertise, you must either include evidence of a one-time achievement (major internationally-recognized award) or 3 of the 10 noted criteria below (or equivalent proof if any of the requirements do not readily use):
– Evidence of receipt of lower nationally or globally recognized rewards or awards for excellence
– Evidence of your membership in associations in the field which demand outstanding achievement of their members
– Evidence of published product about you in expert or significant trade publications or other major media
– Evidence that you have been asked to evaluate the work of others, either separately or on a panel
– Evidence of your initial clinical, academic, creative, athletic, or business-related contributions of significant significance to the field
– Evidence of your authorship of scholarly posts in professional or major trade publications or other significant media
– Evidence that your work has actually been displayed at artistic exhibits or showcases
– Evidence of your efficiency of a leading or critical function in prominent companies
– Evidence that you command a high income or other substantially high remuneration in relation to others in the field
– Evidence of your business successes in the performing arts

** Examples of Documentary Evidence That a Person is an Outstanding Professor or Researcher
In order to demonstrate you are an impressive professor or scientist, you need to include evidence of 2 of the 6 noted requirements below (or equivalent evidence if any of the requirements do not easily use):
– Evidence of receipt of major rewards or awards for
– Evidence of subscription in associations that need their members to demonstrate outstanding accomplishment
– Evidence of published product in professional publications written by others about the alien’s work in the academic field
– Evidence of involvement, either on a panel or separately, as a judge of the work of others in the exact same or allied scholastic field
– Evidence of original scientific or scholarly research contributions in the field
– Evidence of authorship of academic books or articles (in academic journals with worldwide blood circulation) in the field

Application Process
Extraordinary Ability: You may look for yourself by submitting a Form I-140, Petition for Alien Worker.
Outstanding Professors and Researchers: Your U.S. company need to submit a Kind I-140, Petition for Alien Worker. As part of the application procedure, employment your company must be able to demonstrate a continuing capability to pay the provided wage since the concern date. Your company might use an annual report, federal income tax return, or audited monetary declaration to demonstrate a continuing capability to pay your wage.
Multinational Manager or Executive: Your U.S. company should file USCIS Form I-140, Petition for Alien Worker. As part of the application procedure, your company needs to be able to show a continuing ability to pay the used wage as of the top priority date.
