Employment-Based Immigration: first Preference EB-1
You may be eligible for an employment-based, first-preference visa if you are an alien of amazing ability, are an exceptional teacher or researcher, or are a particular multinational executive or supervisor. Each occupational classification has specific requirements that must be met:
Your petitioning company must be a U.S. employer and plan to use you in a managerial or executive capability. The petitioner must have been doing service in the U.S. for a minimum of 1 year, as a legal entity with a qualifying relationship to the entity that employed you abroad in a supervisory or executive capability.
No labor employment accreditation is required.
* Criteria for Demonstrating Extraordinary Ability
In order to show you have sustained national or global praise and employment that your accomplishments have actually been recognized in your field of proficiency, you should either include proof of a one-time accomplishment (significant internationally-recognized award) or employment 3 of the 10 listed criteria listed below (or employment equivalent proof if any of the criteria do not readily apply):
– Evidence of receipt of lesser nationally or internationally recognized rewards or awards for excellence
– Evidence of your membership in associations in the field which demand exceptional accomplishment of their members
– Evidence of published material about you in professional or significant trade publications or other significant media
– Evidence that you have been asked to evaluate the work of others, either separately or on a panel
– Evidence of your initial clinical, academic, creative, athletic, or business-related contributions of major significance to the field
– Evidence of your authorship of academic articles in expert or major trade publications or other major media
– Evidence that your work has been shown at creative exhibitions or showcases
– Evidence of your performance of a leading or employment important function in distinguished organizations
– Evidence that you command a high wage or other substantially high remuneration in relation to others in the field
– Evidence of your commercial successes in the carrying out arts

** Examples of Documentary Evidence That a Person is an Exceptional Professor or Researcher
In order to show you are an impressive professor or scientist, you need to consist of proof of 2 of the 6 noted criteria below (or similar proof if any of the criteria do not easily apply):
– Evidence of invoice of major rewards or awards for impressive accomplishment
– Evidence of subscription in associations that need their members to show impressive achievement
– Evidence of published product in expert publications composed by others about the alien’s work in the academic field
of participation, either on a panel or separately, as a judge of the work of others in the exact same or allied scholastic field
– Evidence of original scientific or employment scholarly research contributions in the field
– Evidence of authorship of academic books or short articles (in academic journals with worldwide blood circulation) in the field

Application Process
Extraordinary Ability: You might use for yourself by submitting a Type I-140, Petition for Alien Worker.
Outstanding Professors and Researchers: Your U.S. company must file a Type I-140, Petition for Alien Worker. As part of the application process, your company needs to have the ability to show a continuing capability to pay the used wage as of the concern date. Your company may use an annual report, federal earnings tax return, or audited monetary statement to demonstrate a continuing capability to pay your wage.
Multinational Manager or Executive: Your U.S. company must file USCIS Form I-140, Petition for Alien Worker. As part of the application process, your employer should be able to show a continuing ability to pay the provided wage since the concern date. Your employer may utilize a yearly report, federal income tax return, or audited financial declaration to show a continuing capability to pay your wage.
